By Sadia Javed – Advocate High Court, Family Law Specialist at SJ Law Experts, Islamabad
As a practicing Advocate High Court and experienced Family Court lawyer in Islamabad, I regularly assist clients with Khula (judicial divorce) cases. Many women in Pakistan approach us when their marriage has broken down beyond repair, and they need professional legal representation to safeguard their rights and dignity.
This article provides a complete legal guide on Khula in Pakistan, including grounds, procedures, relevant case law, and practical insights based on my courtroom experience.
1. What is Khula in Pakistan?
In Islamic and Pakistani law, Khula is the wife’s legal right to seek the dissolution of marriage if she feels she cannot continue living with her husband “within the limits prescribed by Allah.”
- Section 10 of the Family Courts Act, 1964 governs Khula in Pakistan.
- The Dissolution of Muslim Marriages Act, 1939 also provides circumstances where a woman can seek judicial divorce.
- Unlike divorce (talaq) initiated by the husband, Khula empowers women to approach the court for dissolution of marriage, often by returning dower (haq mehr).
2. Grounds for Khula in Pakistan
While a wife can file for Khula without proving her husband’s fault, several recognized legal grounds strengthen her case:
- Non-Maintenance
- If a husband fails to provide financial support (nafaqa) for two years or more.
- Case Law: PLD 2003 Lahore 180 – Court granted Khula where the husband persistently failed to provide maintenance.
- If a husband fails to provide financial support (nafaqa) for two years or more.
- Cruelty or Abusive Behavior
- Physical violence, habitual abuse, or mental cruelty.
- Case Law: 2016 YLR 1448 – Mental and physical cruelty validated Khula.
- Physical violence, habitual abuse, or mental cruelty.
- Irretrievable Breakdown of Marriage
- Continuous quarrels, lack of trust, or failed reconciliation.
- Case Law: PLD 2006 SC 613 – Supreme Court upheld Khula on irreconcilable differences.
- Continuous quarrels, lack of trust, or failed reconciliation.
- Other Valid Grounds under Islamic Law
- Husband’s impotence, imprisonment, incurable illness, or immoral conduct.
3. Khula Procedure in Islamabad Family Courts
From my professional experience, the process generally follows these six steps:
- Filing of Petition – Wife (plaintiff) files a Khula suit through her lawyer.
- Notice to Husband – Court issues summons for husband to appear.
- Reconciliation Efforts – Court attempts reconciliation under Section 10(3) of the Family Courts Act.
- Recording of Evidence – Both parties submit evidence and statements.
- Court Decree – If reconciliation fails, the court dissolves the marriage.
- Union Council Procedure – Court decree is sent to the Union Council for issuance of divorce certificate after iddat (90 days).
4. Relevant Case Law on Khula in Pakistan
Courts have consistently upheld women’s rights to Khula in cases of cruelty, non-maintenance, and irretrievable breakdown of marriage:
- PLD 2003 Lahore 180 – Non-maintenance justified dissolution.
- PLD 2006 SC 613 – Supreme Court recognized irretrievable breakdown as valid ground.
- 2016 YLR 1448 – Cruelty and abuse upheld as grounds for Khula.
- PLD 2014 SC 330 – Wife’s return of dower is procedural unless exceptions apply.
5. Common Questions About Khula
- How long does Khula take in Islamabad?
Typically 3–6 months, depending on court workload. - Do I have to return my dower (haq mehr)?
Usually yes, unless grounds under the 1939 Act apply (e.g., cruelty, non-maintenance). - Can I file Khula without a lawyer?
Legally possible, but highly discouraged — the process is complex. - Does Khula affect child custody?
No. Custody is decided separately under the Guardians and Wards Act, 1890, based on the welfare of minors.
