Muslim Marriage Family Law

A Muslim Marriage is a contract and can be dissolved like any other contract(s). It is automatically dissolved on the death of one of the spouses. Other than this, both wife and husband have their legal and religious rights to dissolve a marriage. A husband has the unilateral right of Talaq, which can never be taken away but can be restricted through the Nikah-Nama. A wife can dissolve her marriage unilaterally only if the right of divorce has been unconditionally delegated to her by the husband in the Nikah-Nama.

Other forms of dissolution of marriage which the wife can use are “Khula” and “Judicial Divorce” (including option of Puberty). These both have to be sought through the Family Courts.

Divorce Papers

​If a Husband is seeking to give divorce to his wife or on the other hand if a wife is seeking to exercise her delegated right of divorce in her Nikha-Nama, then Divorce papers are prepared by their Lawyers. If both parties agree to divorce each other then a mutual divorce deed is prepared, whereas it is commonly one sided.

A Divorce Deed is prepared wherein a brief history of marriage and child description is narrated, which is supplemented with terms and conditions of divorce if any. It is also mentioned that the amount of “Haq Meher” is returned by way of a cheque/ Pay order and the same is tendered along with original Divorce Papers. The Divorce Deed is couriered to the recipient and it is ensured that the same is received.

Child Custody:

A child custody agreement is an extremely important document subsequent for divorce parenting. It is essential that the areas of concern are covered in the said agreement and therefore a child custody agreement needs a lot of consideration in drafting.​​

The key ingredients of a child custody agreement include:

  • Residency including provisions for geographic moves etc.
  • Access periods for each parent including holidays and other special events and occasions
  • Decision making and responsibilities regarding education, health and religion
  • Financial responsibilities in the form of child support obligations.

Adoption in Pakistan:

​Adoption is a fairly simple and a quick process in Pakistan. Our experienced lawyers are regularly consulted for adoption services and we fully understand the delicate nature of such legal proceedings.

Child Maintenance:

In accordance with the Pakistani and Islamic law – it is the duty of the father to provide for maintenance to his child. In the event of divorce or separation, it is likely that fathers discontinue the maintenance of their children. In such circumstances, the mother of the Child can apply to the court to have the father pay for the child’s necessary expenses and needs. Maintenance orders are passed within delay and the amount is collected strictly as a collection of revenue or tax.

Court Marriage:

The procedure for court marriage is to supply copies of National Identity Card, Two copies of photos with white or blue background and proper verification of age and identity. The minimum age for a Girl to get married is 18 and for a boy is also 18 years. Age verification is necessary and the same can be done by way of producing copies of National Identity Card, Form B or Educational Certificate.
